ORGANIC LAW OF THE MINISTRY OF TOURISM, TRADE AND INDUSTRY
The Programme of IV Constitutional Government provides for a policy of development of tourism activities, business and industry, as a mechanism of capital importance in reducing the poverty and the fight against unemployment, contributing positively to social and political stability of the country.
The Decree-Law No. 7/2007 of 5 September 2007 laying down the organizational structure of IV constitutional Government of Democratic Republic of Timor-Leste determines, in its Section 37, in formulating or amending their Ministries Organic Laws. This Decree-Law establishes the structure of organs and services that comprise the Ministry of tourism, Trade and Industry, giving them the skills necessary for the prosecution of the Government policies for these areas, in line with the provisions of Section 29 of that law.
Therefore ,
The Government decrees, pursuant to paragraph 3 of Section 115 of the Constitution of the Republic to act as law, the following:
Chapter I
Nature and Assignments

Nature
The Ministry of tourism, Trade and Industry, hereinafter MTCI, is the central organ of Government whose mission is to develop, regulate, run, coordinate and evaluate the policy defined and approved by the Council of Ministers, to the fields of tourism, Trade and industry.
Section 2
Assignments
In pursuit of its mission, are tasks of MTCI:
a) Propose policies and draw up the draft rules and regulations necessary to their areas of responsibility;
b) Design, execute and evaluate trade policy;
c) Contribute to boost commercial economic activity, including the internal and international competitiveness;
d) Analyze the business activity and to propose relevant measures and public policies for business development and international trade;
e) Support the activities of economic operators of the commercial and industrial sectors, promoting the necessary ways for valid solutions in order to make it simple and swift to administrative proceedings, limiting it to the indispensable.
f) Advising on previous requested information for the establishment of trading companies as well as to acquire the status of investor;
g) Evaluate and give licence for projects of installations and operation of industrial, commercial and touristic resorts;
h) Support commercial activities, including building markets, aiming at the enhancement of the conditions thereof;
i) Inspect and monitor the economic activities of their guardianship, pursuant to law; Conceive, implement and evaluate policies in the industrial sector;
j) Maintain and administer information and documentation centre on companies and industrial activities;
k) Propose the revocation or suspension of the licence of industrial activities performance , when appropriate;
l) Propose the qualification and classification of industrial projects, in particular, the economic activities in general;
m) Organize and administer the register of industrial property;
n) Promote the internal rules and international standardisation, metrology and quality control, measurement standards of physical units and magnitude;
o) Design, implement and evaluate national tourism policy, including the aspects of leisure, fun and ecotourism;
p) Prepare the annual plan of activities for the development of tourism with its estimated costs;
q) Implement and enforce the legislation concerning installation, licensing, sorting and checking the status of operation of tourist facilities;
r) Establish mechanisms for collaboration with other governamental departments and agencies on related areas, in particular the competent services planners and physical development of the territory to promote strategic areas of national tourism development;
s) Cooperate with the competent bodies and public institutes, national and international, for Timor-Leste promotion and disclosure , with investors and tour operators;
t) Regulating the organized association of the activities and professions of the industrial, commercial and touristic sectors ,rationally and integrated , preferably under a single representative structure.
u) Regulating and supervising the industrial, commercial and touristic activities , especially, those of conditioned access, and or reserved , liable to licencing or public concession in collaboration with related entities and policies defined by the government;
v) Analyze and propose to the Council of Ministers the formation of international partnerships activities subject by MTCI, depending on the cost-benefits for the Country.
w) Manage the budget, procurement and internal finance, under the law.

The MTCI is superiorly tutored by the Minister, that represents and shall be accountable to the Prime Minister.
Chapter III
Organic Structure

General Structure
1. The MTCI pursues its mission through integrated services in the direct administration of the State bodies involved in indirect administration and territorial delegations advisory bodies.
2. By reasoned order of the Minister, can be created territorial delegations of tourism services, Commerce and industry, in furtherance of deconcentration measures or administrative and financial decentralization, under the law.
Section 5
Services of direct administration of the State:
1) Integrate direct administration of the State, under the MTCI, the following core services:
a) Directorate-General;
b) Inspection and Internal Audit;
c) National Tourism Directorate;
d) National Directorate of Domestic Trade;
e) National Directorate of Foreign Trade;
f) National Directorate of Industry
g) National Directorate of Administration and Finance;
h) National Directorate of Research and Development
2) With technical and administrative autonomy, but under the tutelage of functional and integrate financial oversight, Minister of MTCI , still continue the structure and tasks of the following bodies:
a) Economic and Food Inspection.
b) General Inspectorate of games
Section 6
Food and Economic Inspection and General Inspection of Games by proposal of the Minister of Tourism, Trade and Industry, the Council of Ministers may approve the conversion of such bodies, giving them financial autonomy and assets, with the objective of meeting the operational requirements of the Ministry where indirect administration mode is best suited to serve the public interest.
